1. Acknowledgment of Activity and Risks
FloorTech Concrete Coatings LLC may provide demonstrations, promotional contests, physical challenges, equipment displays, warehouse/shop visits, job site walkthroughs, or other interactive activities (collectively, the “Activity”).
You acknowledge and understand that participation in such activities may involve physical exertion, interaction with tools or equipment, proximity to construction materials, uneven surfaces, wet coatings, machinery, or other potentially hazardous conditions.
You understand that risks may include, but are not limited to:
- Slips, trips, and falls
- Exposure to tools, grinders, vacuums, generators, or equipment
- Contact with coatings, solvents, or materials
- Muscle strains or physical injury
- Property damage
- Serious bodily injury, permanent disability, or death
You voluntarily choose to participate with full knowledge and understanding of these risks and agree that participation is entirely at your own risk.
2. Equipment Disclaimer and Medical Responsibility
Any equipment, tools, or materials involved in the Activity are provided “as is,” without warranties of any kind, express or implied.
You accept full responsibility for:
- Inspecting your surroundings
- Exercising caution
- Following all safety instructions
- Refraining from participation if you feel unsafe
The Company does not provide medical insurance coverage for participants. You agree that you are solely responsible for any medical expenses resulting from participation.
You certify that:
- You are physically able to participate.
- You do not have any condition that would increase your risk of injury.
- You are not under the influence of alcohol, drugs, or substances that may impair your judgment.
3. Assumption of Risk and Release for Negligence
You expressly assume all risks associated with participation in the Activity, whether arising from:
- Your own actions
- The actions of other participants
- Facility conditions
- Equipment failure
- Construction or warehouse environments
- The ordinary negligence of the Company or its representatives
To the fullest extent permitted under the laws of the Commonwealth of Virginia, you hereby waive, release, and forever discharge FloorTech Concrete Coatings LLC and its owners, members, managers, officers, employees, agents, contractors, affiliates, and representatives from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to participation in the Activity, including those caused by ordinary negligence.
This release does not apply to gross negligence or willful misconduct, as prohibited by Virginia law.
4. Indemnification and Personal Property
You agree to indemnify, defend, and hold harmless the Company and all released parties from any claims, damages, losses, liabilities, costs, and attorneys’ fees arising out of or related to:
- Your participation in the Activity
- Your conduct
- Any third-party claims caused by your actions
You assume full responsibility for any loss, theft, or damage to personal property brought onto Company premises or event locations.
5. Emergency Medical Consent and Media Release
You authorize the Company and its representatives to obtain emergency medical treatment for you if reasonably necessary. You agree to be financially responsible for any such treatment and release the Company from liability related to the provision or delay of emergency care.
You grant FloorTech Concrete Coatings LLC the irrevocable right to photograph, record, or film you during the Activity and to use such images or recordings for marketing, promotional, social media, website, advertising, or other lawful business purposes without compensation.
6. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.
Any legal action arising from this Agreement shall be brought exclusively in the state courts located in Virginia, and you consent to the jurisdiction of such courts.
7. Acknowledgment and Voluntary Execution
You acknowledge that:
- You have read this Agreement carefully.
- You fully understand its contents.
- You are voluntarily giving up important legal rights, including the right to sue for negligence.
- You are signing this Agreement freely and voluntarily without coercion.
